Who can an order of protection be between?

Orders of Protection can be had between spouses, former spouses, unmarried couples, former couples who have lived together or had a child together, or others. There are certain persons who can file for an Order of Protection, but it does not apply to all. In the family law arena, if a divorce is involved, the Order of Protection hearing will be transferred to be heard in the divorce court. If no divorce has been filed, the matter remains in front of the criminal courts.

In the day and age of social media and e-communication, proof of threats of physical violence toward a party can be prevalent and useful when requesting an Order of Protection. If no proof, then the hearing may come down to the credibility of the witnesses, so if someone witnessed the violence or the threat of violence, it is necessary for that information to be provided to the court by the witness.
